Terms of Service

These terms govern your use of ProductLobster. By creating an account or using the Service, you agree to them.

1. The Service

ProductLobster ("ProductLobster", "we", "us") provides the agentic Product Brain — context engineering for product teams — for builders and operators. The Service includes our marketing website at productlobster.ai, the authenticated application at app.productlobster.ai, and any APIs we publish. These Terms govern your access to and use of the Service. Our Privacy Policy is incorporated by reference.

2. Eligibility and accounts

You must be at least 18 years old to use the Service. By creating an account, you represent that the information you provide is accurate and that you have the authority to enter into these Terms. You are responsible for activity that occurs under your account and for keeping your authentication credentials confidential.

The Service is currently offered through a private beta. We may modify availability, eligibility criteria, or pricing for any generally available plan as the Service evolves.

3. Acceptable use

You agree not to (and not to enable others to):

  • Use the Service to generate content that infringes intellectual property, violates privacy, or breaks applicable law.
  • Attempt to extract our system prompts, model weights, or proprietary instructions, including by prompt injection embedded in product ideas, chat messages, or uploaded documents.
  • Reverse engineer, scrape at industrial scale, or otherwise abuse our APIs, rate limits, or fair-use protections.
  • Upload malware, automate account creation, or attempt to circumvent our security and authentication systems.
  • Use the Service to generate or distribute content that targets, harasses, or endangers other people.

We reserve the right to suspend or terminate accounts that violate these rules, and to remove content that breaks our acceptable-use policy.

4. Your content

You retain ownership of the product ideas, descriptions, chat messages, uploaded documents, and generated artifacts associated with your workspace ("Your Content"). You grant ProductLobster a limited, non-exclusive license to process Your Content solely to provide the Service to you — including persisting it across sessions, running analyses, generating prototypes and PRDs, and building your workspace knowledge graph.

You are responsible for ensuring you have the rights to submit Your Content. Do not upload material you do not have permission to process through an AI system.

5. AI-generated output

ProductLobster uses large language models to generate strategic analyses, recommendations, prototypes, and PRDs. AI output can contain errors, omissions, and outdated information. Treat all AI-generated content as a draft to review and validate — not as professional advice, legal counsel, or a guaranteed business outcome. You are responsible for the decisions you make based on Service output.

Subject to your compliance with these Terms and applicable law, you may use AI-generated output produced from your workspace for any lawful purpose, including commercial use. You acknowledge that similar prompts may produce similar output for other users; we make no representations that AI output is unique to you.

6. Intellectual property

The Service — including its source code, design, branding, prompts, frameworks, and documentation — is owned by ProductLobster and protected by intellectual property laws. These Terms do not grant you any right to our marks, logos, or proprietary materials beyond using the Service as intended.

7. Subscriptions and billing

When paid plans are available, billing is processed by Stripe under their terms. Fees are due in advance for the selected billing period, are non-refundable except where required by law, and continue until you cancel. We may change pricing or plan features with reasonable notice; changes take effect at the start of the next billing period.

8. Service availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may add, modify, or discontinue features at any time. Where a change materially reduces functionality on a paid plan, we will provide reasonable notice and, where appropriate, a pro-rata credit or refund.

9. Termination

You may stop using the Service and delete your account at any time from inside the application. We may suspend or terminate accounts that violate these Terms, fail to pay subscription fees, or pose a security or abuse risk. On termination, your access ends; we will retain or delete remaining data consistent with our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT AI-GENERATED OUTPUT IS ACCURATE, COMPLETE, OR FIT FOR YOUR INTENDED USE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCTLOBSTER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (b) US$100.

12. Indemnification

You agree to indemnify and hold ProductLobster harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, or Your Content.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, except where applicable consumer-protection law gives you rights you cannot waive.

14. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date at the top of the page reflects the most recent revision. Material changes will be communicated by email or in-app notice before they take effect; continued use of the Service after the effective date constitutes acceptance.
